This Disclaimer governs your use of netxafe.ca and all services, reports, and communications provided by Netxafe. By using our website or services, you acknowledge and accept the limitations set out below.
1. No Guarantee of Complete Security
Netxafe’s assessments are designed to identify known, publicly detectable security exposures at the time of assessment. We expressly disclaim any warranty that our services will identify all security vulnerabilities, that implementing our recommendations will prevent all cybersecurity incidents, or that your systems are or will be fully secure following our engagement.
2. Point-in-Time Assessment
All Netxafe Scan reports and Audit reports represent a snapshot of your organisation’s security posture at the specific date and time of assessment. The cybersecurity threat landscape evolves continuously. Netxafe assumes no responsibility for changes in your security posture that occur after the date of assessment.
3. Passive Reconnaissance Only
Netxafe Scan services constitute passive, external-facing reconnaissance only. Our scans do not involve active exploitation of vulnerabilities, internal network penetration testing, social engineering, or application-layer penetration testing. Our services are distinct from and should not be interpreted as a comprehensive penetration test.
4. Not Legal or Regulatory Advice
Information and guidance provided by Netxafe regarding PIPEDA or any other regulation is general in nature and provided for informational purposes only. It does not constitute legal advice. Clients should seek independent legal counsel for advice on their specific regulatory obligations.
5. Limitation of Liability
To the fullest extent permitted by applicable law, Netxafe shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your reliance on our reports or any cybersecurity incident occurring before, during, or after our engagement. Our maximum aggregate liability is limited to the fees paid by you in the three months preceding the event giving rise to the claim.
